District Attorney John Rustgard arrived from Juneau this morning and will remain in Skagway for a few days. The mission of Mr. Rustgard in coming here at this time is to consult with President O. L. Dickeson of the White Pass and Mr. Close, one of the principal directors of the company, regarding the relinquishment of their claims on the old Brackett road, to the extent of having it thrown open in case the United States should at any time desire to open a highway over it.
The matter has been opened between the district attorney's office and the White Pass company, as a result of an order from the department of Justice at Washington, directing Attorney Rustgard to begin steps towards securing the relinquishment of the road but the matter has not been definitely settled.
Mr. Rustgard informs the Daily Alaskan that in case the White Pass company refuses to grant the relinquishment, he is instructed to begin legal proceedings immediately for annulment of the franchise on the grounds that it has been forfeited. As both Mr. Dickeson and Mr. Close are expected back on tonight's train, the matter will be taken up with them immediately upon their return.
